Booking Policy ​Acknowledgment of Risks I, the undersigned, understand and acknowledge that my participation in the above-described activity/event involves inherent risks, hazards, and dangers, including but not limited to: Physical Risks: 1. Strenuous physical activity that may lead to sprains, fractures, dislocations, muscle strains, or other injuries. 2. Potential for severe injuries, including concussions, internal injuries, and even death. 3. Risk of injury due to slips, trips, falls, or impacts with objects or other participants. 4. Risk of injury from the use of equipment, including malfunction or misuse of equipment. Environmental and External Risks: 1. Exposure to extreme weather conditions (e.g., heat, cold, rain, lightning) that may result in heatstroke, hypothermia, or other weather-related injuries. 2. Encountering uneven, slippery, or rough terrain that could contribute to falls or injuries. 3. Potential exposure to natural hazards such as wildlife, insects, or plant life, which may cause injury or allergic reactions.Health and Medical Risks: 1). Exacerbation of pre-existing medical conditions or injuries, leading to further health complications. 2). Risk of dehydration, exhaustion, or overexertion. 3). Lack of immediate access to medical facilities or professional medical assistance during the activity/event. ​ Psychological Risks: 1. Emotional distress or psychological trauma resulting from participation, including stress, anxiety, or fear. 2. Potential for experiencing emotional distress due to accidents, injuries, or witnessing distressing events involving others. Social Risks: 1. Potential exposure to communicable diseases, including COVID-19, in group settings. 2. Risks associated with interactions with other participants, including but not limited to conflicts, miscommunications, or misunderstandings. Other Unforeseen Risks: 1. Risks that are not specifically mentioned above but are inherent to the activity/event or its environment. Assumption of Risks I acknowledge that I am voluntarily choosing to participate in the activity/event, fully aware of the risks involved. I understand that my decision to participate is entirely voluntary, and I am free to withdraw from participation at any time. I accept and assume full responsibility for any and all risks of injury, harm, or damage, whether known or unknown, foreseeable or unforeseeable, that may occur as a result of my participation. Emergency Procedures 1. First aid kits are available at the club reception. 2. In case of medical emergencies, call emergency services immediately. 3. Fire exits and evacuation routes must be kept clear at all times. ​ Release of Liability ​In consideration of being permitted to participate in the activity/event, I, on behalf of myself, my heirs, executors, administrators, assigns, and representatives, hereby release, waive, discharge, and hold harmless PowerServe Tennis, its officers, directors, employees, agents, contractors, volunteers, and affiliated entities (collectively referred to as "Released Parties") from any and all liability, claims, demands, actions, or causes of action, arising out of or related to any loss, damage, injury, or harm, including death, that may occur as a result of my participation in the activity/event, whether caused by the negligence of the Released Parties or otherwise. ​​ Indemnification I agree to indemnify, defend, and hold harmless the Released Parties from and against any and all claims, demands, causes of action, damages, liabilities, costs, and expenses, including legal fees, arising out of or related to my participation in the activity/event. This indemnification extends to any claims brought by third parties arising out of my actions or conduct during the activity/event. Medical Authorization I authorize the Released Parties to seek medical attention on my behalf in the event of an injury, accident, or illness during the activity/event. I understand that I am responsible for any and all medical expenses incurred as a result of such treatment, including transportation costs to medical facilities. I declare that I am in good health and physically fit to participate in the activity/event. I have disclosed any medical conditions, allergies, or medications that may affect my participation in the Released Parties. Photographic/Video Release I understand that the activity/event may be photographed or videotaped for promotional or educational purposes. I hereby grant the Released Parties the right to use, reproduce, and distribute any photographs, videotapes, or recordings of my participation in the activity/event, without compensation, for any lawful purpose, including but not limited to promotional materials, websites, and social media. Confidentiality Agreement I agree to maintain the confidentiality of any proprietary or sensitive information disclosed to me by the Released Parties during the activity/event. I will not disclose, share, or use such information for any purpose other than my participation in the activity/event. Governing Law and Jurisdiction This Booking Policy shall be governed by and construed in accordance with the laws of the [ONTARIO/CANADA], without regard to its conflict of laws principles. Any disputes arising out of or related to this waiver or my participation in the activity/event shall be resolved exclusively in the courts of [ONTARIO/CANADA]. Severability If any provision of this waiver is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect. The invalid or unenforceable provision shall be modified to the extent necessary to render it valid and enforceable. Acknowledgment of Understanding I have carefully read and fully understand the terms of this waiver. I acknowledge that I am signing this document voluntarily and with full knowledge of its legal consequences. I understand that by signing this document, I am waiving certain legal rights, including the right to sue the Released Parties for any injuries, damages, or losses that may result from my participation in the activity/event.
